AI Cold Calling: What Is Allowed and What Works

AI can place calls and hold conversations, but consent and calling laws decide whether you may. Here is how to use AI calling agents responsibly.

"AI cold calling" usually means an AI voice agent that dials leads, introduces your business and tries to qualify interest or book a meeting. Technically this is possible. Legally and commercially it is more complicated than the demos suggest. This guide explains the rules in broad terms and the approaches that work. It is not legal advice.

Rules to check before you call

RegionPoints to check (not exhaustive)
United StatesTCPA rules on autodialed and artificial or prerecorded voice calls to mobile numbers, which generally need prior express consent; the FCC has said AI-generated voices count as artificial voices. Do Not Call lists. State rules on calling hours and call recording.
United KingdomPECR rules on marketing calls, Telephone Preference Service (TPS) screening, and GDPR for personal data.
AustraliaDo Not Call Register Act and telemarketing standards, plus the Privacy Act.
IndiaTRAI telemarketing regulations (do-not-disturb preferences and registered telemarketer rules).
EUGDPR and national marketing-call rules, and AI transparency obligations that require telling people they are interacting with an AI system.
Rules differ by state, country and call type (consumer or business), and they change. Get advice from a lawyer for your campaign before calling.

What tends to work better than cold dialing

  • Calling people who asked to hear from you: form submissions, demo requests and enquiries. AI can call within minutes, which usually improves contact rates.
  • Appointment and renewal reminders for existing customers.
  • Missed-call follow-up on enquiries.
  • Warm outreach by email or WhatsApp first, with calls only after interest.

If you do use AI for outbound calls

  1. Confirm consent and do-not-call screening for every number.
  2. Disclose at the start that the caller is an AI.
  3. Offer an easy opt-out and honour it immediately.
  4. Respect calling hours and time zones.
  5. Hand over to a person when the contact wants one.
  6. Keep call logs and consent records.

We build voice agents for consented use cases: inbound answering, reminders and follow-up on enquiries. See AI voice agents and the AI receptionist.

Mistakes to avoid

  • Buying a list and calling it with no consent record.
  • Hiding that the caller is an AI.
  • Ignoring time zones and local calling hours.
  • Not handling opt-outs immediately and across all channels.
  • Measuring only call volume and not complaints and opt-outs.

AI cold calling software and outbound AI calling: what to look for

If you evaluate AI cold calling software or any outbound AI calling tool, check these points before anything else:

  • Does it support consent records, do-not-call list screening and quiet hours by region?
  • Does it disclose that the caller is an AI, and can you edit that script?
  • Can contacts opt out during the call, and is the opt-out applied everywhere at once?
  • Can it hand the call to a person on request?
  • Does it keep call logs, recordings (where lawful) and transcripts securely?
  • What happens to your contact data, and is it used to train models?

Tools differ a lot, so test with a small consented list first and review the calls before scaling.

Frequently asked questions

Is AI cold calling legal?

It depends on the country, the type of call and whether you have consent. In the US, AI-generated voices are treated as artificial voices under the TCPA, so automated calls to mobile numbers generally need consent. Take legal advice.

Do I have to tell people the caller is an AI?

Disclosure is good practice and is required in some jurisdictions. We build it into scripts.

Does AI cold calling work?

Results vary. Calling people who showed interest usually works better than calling cold lists.

Can your agents call my existing customers?

Yes, for reminders and follow-ups where you have the right to contact them.
